Agreement on the rights of use
1. I (hereinafter jointly referred to as the "user") hereby grants novotegra GmbH and the companies affiliated with BayWa r.e. AG within the meaning of Section 15 of the German Stock Corporation Act (hereinafter collectively referred to as “BayWa”) a license, unlimited in terms of time, space and content, to use the images provided for the submitted project. BayWa shall also be permitted to forward the images/film material created for use for press releases, references, etc. at no charge.
2. Further, the user consents to the distribution and publication of the finished images, portraits or reproductions of these images in altered or unaltered form by BayWa or by third parties commissioned by BayWa for any and all promotional purposes of BayWa in all of the presently known publication forms (photography, print, television, cinema and internet, CD, DVD, or modern storage media or playback devices).
3. The user hereby grants BayWa irrevocable right, unrestricted in terms of time, place and content, to save, reproduce, process, and publish the content (photos, films, stories, etc.). Their use shall include all presently known data carriers and forms of publication. If necessary, BayWa shall further be entitled to process or connect the content with other content, thereby creating new content. Processed images do not require approval prior to publication.
4. BayWa assures that it shall not permit or publish any morally offensive changes upon processing or changing the image and film material.
5 The user shall forgo the mention of its name when using the image/film material, however we agree that the name of the company can be mentioned in conjunction with the images taken during the photo shoot or filming, or other images and other names, upon publication.
6. The user declares its consent to the collection, saving, and use of personal data for the purpose of implementing and completing the promotion. BayWa assures that it shall use the data provided in accordance with the applicable data privacy protection laws and only for the purpose specified, and shall not forward them to third parties for purposes other than the purposes specified by the promotion.
7. The consent granted under No. 6 can be revoked at any time in any form by simply contacting novotegra ([email protected]).
8. The licence shall be transferred free of charge as part of the award of contract, all resulting claims have been fulfilled.
9. The user hereby waives receipt of a declaration of acceptance by BayWa to this declaration of consent.
